INTRODUCTION

These Payments Terms of Use govern payment services for purchases made through Snowtrack.shop and supplement the Snowtrack User Agreement. Capitalized terms not defined here have the meanings given in the User Agreement. These Payments Terms of Use supersede any conflicting provisions in other Snowtrack agreements.

1. PAYMENT TERMS

• Agreement Basis: Payments are made on the basis of the agreement between Snowtrack and the buyer; currency and payment method are mutually agreed and confirmed at checkout.
• Currency: Snowtrack lists prices in USD on the site; the currency for any transaction will be confirmed at checkout.
• No Additional Transaction Fees by Snowtrack: Snowtrack does not add extra transaction fees to the buyer beyond the agreed price. Any third-party processor or bank fees remain the responsibility of the payer unless otherwise stated.

2. ORDER PROCESSING

• Payment Before Processing: Orders will not be processed, packed, or dispatched until full payment has been received and confirmed by Snowtrack.
• Finality of Sale: Once payment is confirmed and the order is accepted by Snowtrack, the sale is final except where statutory consumer rights apply.

3. RETURNS, REFUNDS, AND CANCELLATIONS

• General Rule: Snowtrack standard position is that there are no returns and no refunds once goods are collected or delivered and once payment is confirmed, except as required by applicable law.
• Statutory Consumer Rights in Zimbabwe: Notwithstanding the general rule, consumers in Zimbabwe retain rights under the Consumer Protection Act (2019) and related statutes, including implied warranties of quality and the right to remedies where goods are defective, not of merchantable quality, or not fit for purpose. Snowtrack will comply with these statutory rights and provide remedies (repair, replacement, or refund) where the law requires.
• Cancellations: Orders may be cancelled by the buyer only before payment is made and accepted by Snowtrack. If Snowtrack cancels an order after payment for reasons within Snowtrack control, Snowtrack will provide a refund in accordance with applicable law.

4. PROHIBITED ITEMS AND INDEMNITY

• Prohibited Items: Snowtrack will not process payments for restricted or prohibited goods or services. Buyers must not use Snowtrack to purchase items that are illegal or restricted under applicable law.
• Indemnity: Buyers agree to indemnify and hold Snowtrack harmless from any chargebacks, claims, penalties, fines, or losses arising from breaches of these Payments Terms of Use, misuse of payment methods, or transactions involving prohibited items.

5. SECURITY AND DATA PROTECTION

• Account Security: Buyers are responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account.
• Third-Party Processors: Snowtrack may use third-party payment processors, banks, and compliance providers to process payments and perform KYC or AML checks. By transacting on Snowtrack, buyers consent to the transfer and processing of payment and identity data by such providers.
• Data Consent: Buyers consent to the collection, use, and transfer of personal and payment data as necessary to complete transactions and comply with legal obligations. Snowtrack will handle personal data in accordance with its Privacy Policy and applicable law.

6. AMENDMENTS AND ASSIGNMENT

• Amendments: Snowtrack may amend these Payments Terms of Use from time to time. Notice may be given by posting updated terms on the Snowtrack website or by other reasonable means. Continued use of Snowtrack payment services after notice constitutes acceptance of the amended terms.
• Assignment: Snowtrack may assign or transfer its rights and obligations under these Payments Terms of Use to an affiliate or third party. Buyer rights will not be reduced by such assignment.

7. PAYMENT OPTIONS AND CHARGES

• Cash on Delivery: If offered, COD availability and terms will be displayed at checkout. COD may be subject to additional handling charges and is only available where Snowtrack explicitly offers it.
• International Payments: For international buyers, Snowtrack confirms currency and any cross-border processing requirements at checkout. Buyers are responsible for any foreign exchange or bank charges unless Snowtrack states otherwise.

8. COMPLIANCE NOTES AND BUYER GUIDANCE

• Verify Before Payment: Because Snowtrack standard terms treat sales as final once payment is confirmed, buyers should verify product details, quantities, delivery addresses, and payment currency before completing payment.
• Statutory Remedies: Where goods are defective or not as described, buyers in Zimbabwe may rely on remedies under the Consumer Protection Act (2019). Snowtrack will honor statutory obligations and cooperate with dispute resolution mechanisms established by the Consumer Protection Commission.

• Questions and Disputes: For payment queries, disputes, or to report unauthorized transactions, buyers should contact Snowtrack customer support using the contact details on the website. Snowtrack will investigate and respond in accordance with its policies and applicable law.
